Misago — Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Misago mobile application and related services (the “Service,” “Misago,” or the “App”), operated by MISAGO LLC, a Washington limited liability company (“MISAGO,” “we,” “us,” or “our”). Misago is the brand and product name; MISAGO LLC is the operating company. By creating an account, installing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Beta notice. Misago is currently offered as a free, invitation-only closed beta. The Service is pre-release software. See Section 5 (Beta / Pre-Release Terms).

License note. These Terms include the software license for the App (Section 4). For copies obtained through the Apple App Store, Apple’s Licensed Application End User License Agreement (Standard EULA) also applies as described in Section 4(d); where it conflicts with these Terms as to the iOS/iPadOS app, the relevant Standard EULA term controls.

1. Eligibility

You must be at least 18 years old to use the Service. By using Misago you represent that you are 18 or older and able to form a binding contract.

2. What Misago is — and is not

Misago is an informational tool that helps owners of supported vehicles understand and plan repair and maintenance work. It answers questions in plain language and assembles step-by-step guidance grounded in the vehicle’s factory service manual, citing the source where it can, and clearly labeling guidance that comes from general knowledge or web sources rather than the manual.

Misago’s guidance is produced in part by artificial intelligence, and AI output may be inaccurate, incomplete, or not appropriate for your specific vehicle’s configuration or condition. A source citation indicates where guidance was drawn from — it is not a warranty that the guidance is correct or complete. You should evaluate guidance for your circumstances and verify it before relying on it (see Section 3).

Misago is a co-pilot, not a substitute for the official factory service manual, for a qualified professional mechanic, or for your own judgment. It does not perform repairs, inspect your vehicle, or guarantee any outcome.

3. Safety, assumption of risk, and how Misago handles risk (READ THIS SECTION)

Automotive repair is inherently dangerous. Working on vehicles can cause serious injury, death, or property damage — from vehicles falling, fuel fires, stored energy, electrical hazards, or incorrect reassembly of safety-related systems. You assume all risk arising from your use of Misago and from any work you choose to perform.

You are solely responsible for:

• Assessing your own skill level, tools, and workspace before beginning any task, and stopping if a task is beyond your ability;
• Verifying every step, specification, and torque value against your actual factory service manual before you act on it — especially anything safety-related;
• Following all applicable safety practices (secure lifting and support, eye protection, fire safety, disconnecting power where appropriate); and
• The consequences of any repair you undertake.

How Misago classifies work. Misago reviews each task and assigns a risk level. For tasks it considers within skilled-DIY scope — including higher-risk jobs — it provides guidance together with safety call-outs and, where applicable, a required-equipment note; you still proceed at your own risk and must verify against your manual. For tasks it classifies as restricted (for example, airbag/SRS or high-voltage systems), Misago will not provide a procedure and will direct you to a qualified professional; any accompanying information is for understanding only.

“Verify in your manual” notes. Where Misago could not ground a specific detail in the factory manual, it flags that gap. You must look up those details in your manual or with a professional before relying on them.

If you are ever unsure, stop and consult a qualified professional.

4. License to use the App

(a) License grant

Subject to these Terms, MISAGO grants you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your personal, non-commercial use, and subject to the terms of the app store through which you obtained it.

(b) License restrictions

You may not:

• reverse-engineer, decompile, disassemble, or attempt to derive the App’s source code, models, or prompts (except to the extent this restriction is prohibited by applicable law);
• sublicense, rent, lease, sell, redistribute, or otherwise transfer the App;
• remove or alter any proprietary notices; or
• copy the App except as permitted by this license and the applicable app-store usage rules.

(c) Ownership

The App is licensed, not sold. MISAGO retains all right, title, and interest in the App, the Misago name and logos, the software, and the organization and presentation of content. Factory service manual content remains the property of its respective rights holder; Misago’s role is to transform and cite it, not to transfer rights in it to you.

(d) Apple App Store — Licensed Application additional terms

For the App obtained through the Apple App Store, your license is also governed by Apple’s Licensed Application End User License Agreement (“Apple Standard EULA”), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/, except as modified by these Terms. The following additionally apply, and control over conflicting terms with respect to your use of the iOS/iPadOS version:

• Acknowledgement. These Terms are between you and MISAGO LLC only, not with Apple Inc. (“Apple”). MISAGO LLC, not Apple, is solely responsible for the App and its content.
• Scope of license. The license is limited to a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the Apple Media Services Terms and Conditions and the Usage Rules.
• Maintenance and support. MISAGO LLC is solely responsible for any maintenance and support. Apple has no obligation to furnish any maintenance or support.
• Warranty. MISAGO LLC is solely responsible for any product warranties, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple will have no other warranty obligation, and any other claims attributable to a warranty failure are MISAGO LLC’s responsibility.
• Product claims. MISAGO LLC, not Apple, is responsible for addressing any claims relating to the App or your use of it, including product-liability claims, claims that the App fails to conform to a legal or regulatory requirement, and claims under consumer-protection, privacy, or similar laws.
• Intellectual property. In the event of a third-party claim that the App or your use of it infringes that party’s intellectual property rights, MISAGO LLC, not Apple, will be responsible for the investigation, defense, settlement, and discharge of such a claim.
• Legal compliance. You represent that (i) you are not located in a country subject to a U.S. Government embargo or designated “terrorist-supporting,” and (ii) you are not on any U.S. Government list of prohibited or restricted parties.
• Third-party beneficiary. You and MISAGO LLC acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms (as they apply to the iOS/iPadOS app), and that upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary.

(e) Google Play

For the App obtained through Google Play, your use is also subject to the Google Play Terms of Service. MISAGO LLC, not Google, is solely responsible for the App.

5. Beta / Pre-Release Terms

While Misago is offered as a beta:

• Pre-release, “as is.” The Service is under active development. It may be incomplete, may contain bugs or inaccuracies, may change at any time, and may be suspended or discontinued without notice. It is provided on an “AS IS” and “AS AVAILABLE” basis with no service-level or uptime commitment.
• No fees now; this may change. The beta is free. We may introduce paid features in the future; if we do, beta participants will be notified before any charge applies.
• Feedback license. If you provide feedback, suggestions, bug reports, flagged inaccuracies, or other input (“Feedback”), you grant MISAGO a worldwide, perpetual, irrevocable, royalty-free license to use, modify, and incorporate that Feedback into the Service and our products for any purpose, without obligation or compensation to you. We may de-identify Feedback before use.
• Data may be reset. Beta data (including accounts, tasks, and generated plans) is not guaranteed to persist and may be reset or deleted before or upon general availability.
• Access is revocable. We may modify, limit, or revoke beta access at any time.

6. Your account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Sign-in uses a one-time code sent to your email; we do not store a password. Notify us promptly at the contact address below of any unauthorized use.

7. Acceptable use

You agree not to:

• Reverse-engineer, decompile, or attempt to extract the Service’s underlying models, prompts, or source (as also stated in Section 4(b));
• Scrape, bulk-export, or programmatically query the Service beyond your own ordinary use;
• Use the Service to build or train a competing product or service;
• Use the Service to generate or seek guidance you intend to use unlawfully, or to harm others;
• Upload content that is unlawful, infringing, or that you lack the right to submit;
• Attempt to circumvent the risk-classification or safety features of the Service, or rely on the Service to defeat a manufacturer’s safety system;
• Use the Service unlawfully, or in any way that infringes others’ rights or violates these Terms; or
• Interfere with or disrupt the integrity or performance of the Service, including by introducing malware or placing unreasonable load on it.

8. Intellectual property

• Your content. Content you submit (such as your questions and task descriptions) remains yours. You grant us a license to use it as needed to operate and improve the Service, as described in our Privacy Policy.
• Generated content. Guidance the Service generates for you, based on your inputs, is licensed to you for your personal, non-commercial use with the Service.
• Our property. The Misago name, logos, software, and the organization and presentation of content are owned by MISAGO or its licensors. Factory service manual content remains the property of its respective rights holder.

9. Third-party services

The Service relies on third-party providers, including Anthropic (AI processing), Supabase (hosting, database, and authentication), and PostHog (analytics), and is distributed through the Apple App Store and Google Play. Your use of features that depend on these providers may also be subject to their terms. See our Privacy Policy for how data is shared with these providers.

10. Disclaimers and limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” AND WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MISAGO AND ITS MEMBERS, OFFICERS, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE ARISING FROM YOUR USE OF THE SERVICE OR FROM ANY REPAIR OR MAINTENANCE WORK YOU PERFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD 100.

Some jurisdictions do not allow certain limitations, including limitations on liability for personal injury or for incidental or consequential damages; in those jurisdictions, the above limitations apply to the fullest extent permitted by law and may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless MISAGO from claims, damages, and expenses arising out of your misuse of the Service, your violation of these Terms, or repair work you perform.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. On termination, the license in Section 4 ends and you must stop using the App. Sections that by their nature should survive (including Sections 3, 4(c), 8, 10, 11, and 14) survive termination.

13. Governing law and disputes

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Washington for any dispute not subject to another agreed process. 14. Changes to these Terms

We may update these Terms. If changes are material, we will notify you in the app or by email. Continued use after an update constitutes acceptance.
